Government Contracts Division

The Government Contracts Division was established within the Presidency of the University of Al-Hamdaniya and is administratively linked to the University President, according to the directive of the Ministry of Higher Education and Scientific Research / Administrative and Financial Directorate / Human Resources Department / Organizational Structures Division, No. (11/4/5/1972) dated 11/10/2023. It is also technically linked to the Government Contracts Department at the Ministry of Higher Education and Scientific Research.

The division performs its assigned tasks in cooperation with the Financial and Legal Departments, as well as the Construction and Projects Department at the University Presidency. The goal of the Government Contracts Division is to work towards achieving maximum benefit for the university at the lowest cost and with the highest possible quality standards. This is guided by its mission to adhere to the highest standards of integrity and transparency in concluding contracts where the university is a party, whether with other state institutions or the private sector.

Tasks of the Government Contracts Division:

The Government Contracts Division undertakes various tasks that align with the role it was formed to fulfill. These tasks include:

  1. Executing the procedures for awarding tenders and public auctions.

  2. Preparing and drafting contracts for auctions and tenders after they are awarded, in coordination with the Government Contracts Department at the Ministry of Higher Education and Scientific Research.

  3. Announcing tenders and public auctions.

  4. Coordinating with the Ministry’s headquarters regarding investment projects and the mechanisms for contracting with companies.

  5. Implementing and following up on circulars and official correspondence received from the Ministry of Higher Education and Scientific Research.

  6. Establishing an electronic database containing all legislation, including laws, instructions, and circulars related to government contracts.

  7. Auditing and reviewing contracts before presenting them to the honorable University President for signature.

  8. Preparing and organizing tender documents in coordination with the Construction and Projects Department.

  9. Coordinating with the Government Contracts Department at the Ministry to obtain approvals for selecting the optimal contracting methods, executing contracts signed with companies, and securing official approvals for everything related to the execution of government contracts.

  10. Forming bid opening and analysis (evaluation) committees in coordination with the relevant departments (Engineering, Legal, and Financial).

  11. Performing any other tasks and duties that align with the work of the Government Contracts Division.

Laws and Instructions Governing the Division’s Work:

In performing its duties and executing its assigned tasks, the Government Contracts Division relies on several laws and regulations, including:

  1. The Annual Federal State Budget Laws.

  2. The instructions for executing the Annual Federal Budget Law.

  3. Instructions for Executing Government Contracts No. (2) of 2014.

  4. The Iraqi Civil Code No. (40) of 1951.

  5. The Law on the Sale and Lease of State Property No. (21) of 2013.

  6. The instructions for the Law on the Sale and Lease of State Property No. (21) of 2013.

  7. All circulars and instructions issued by the Ministry of Higher Education and Scientific Research and other relevant government entities.
